Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) is part of, and incorporated into, the Pinecall Terms of Service. It applies to everyone who uses the Pinecall Service operated by DeutschePolska LLC. Capitalized terms have the meaning given in the Terms. If you violate this AUP, we may suspend or terminate your access.
1. Your responsibility
You are solely responsible for the agents you build, the calls and messages they send and receive, the content they generate, and for compliance with all laws that apply to your use of the Service. You must have all rights and consents necessary for the data you process and the people you contact.
2. Telephony & AI-voice compliance
Because Pinecall places and receives phone calls using AI-generated voice, you must comply with all applicable communications laws, including:
- TCPA & FCC rules. Calls that use an artificial or AI-generated voice require the called party’s prior express consent, and prior express written consent for marketing or advertising calls. You are responsible for obtaining and retaining proof of that consent.
- Do-Not-Call. You must scrub against and honor the National DNC Registry, applicable state DNC lists, and your own internal do-not-call and opt-out requests, and must promptly stop contacting anyone who opts out or revokes consent.
- Calling windows. You must respect legally permitted calling hours for the recipient’s location.
- Recording & monitoring. Call recording and transcription are regulated by federal and state wiretap/eavesdropping laws; some states require the consent of all parties. You must provide any legally required recording notice and obtain any required consent before recording.
- AI disclosure. Where required by law, you must disclose that the caller is an automated/AI system and, where applicable, that call content is being analyzed.
- Identification & caller ID. You must accurately identify yourself and must not spoof, falsify or misrepresent caller identification information.
3. Prohibited uses
You must not use the Service to:
- violate any law, regulation or third-party right;
- send unsolicited, fraudulent, deceptive, misleading, harassing or threatening communications, or engage in scams, phishing or social engineering;
- impersonate any person, business or government entity without authorization;
- facilitate illegal activity, or the sale or promotion of illegal goods or services;
- generate or distribute unlawful, hateful, sexually exploitative, or violent content;
- collect or process personal information without a lawful basis, or clone or synthesize a person’s voice without their consent;
- interfere with, overload, or attempt to gain unauthorized access to the Service, our infrastructure, or any third-party system; or
- circumvent usage limits, rate limits, or abuse-prevention measures.
4. Security & fair use
Do not probe, scan or test the vulnerability of the Service without our written permission, and do not use the Service in a way that degrades it for others. We may apply rate limits and anti-abuse controls, and may investigate suspected violations.
5. Enforcement
We may remove content, throttle, suspend or terminate accounts, and cooperate with law enforcement, to address violations of this AUP or risks to the platform or third parties. We may act immediately where use poses a legal, security or reputational risk.
