Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Pinecall voice AI platform, APIs, SDKs, dashboards and related services (collectively, the “Service”). Pinecall is a product operated by DeutschePolska LLC, a New Mexico limited liability company (“DeutschePolska”, “Pinecall”, “we”, “us”, or “our”), the company that provides and sells the Service. By creating an account, connecting a carrier, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

1. The Service

Pinecall lets you build, deploy and operate voice AI agents that place and receive phone calls over telephony carriers and WebRTC. You are responsible for the configuration, prompts, tools and conduct of the agents you create.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity that occurs under your account and API keys. Notify us promptly of any unauthorized use. You must be at least 18 years old and legally able to enter into these Terms.

3. Connecting your Twilio account (Twilio Connect)

Pinecall integrates with Twilio through Twilio Connect. When you choose “Connect with Twilio”, you authorize Pinecall to access and act on a Twilio subaccount associated with your Twilio account in order to provide the Service. By authorizing the connection, you specifically permit Pinecall to:

Pinecall acts only within the scope you authorize and only to deliver the Service. We never receive or store your Twilio Auth Token through Twilio Connect; authorization is granted and managed by Twilio. You may revoke Pinecall’s access at any time from your Twilio Console (Connected Apps) or by disconnecting the carrier in the Pinecall dashboard. Your use of Twilio remains subject to Twilio’s own terms, and any telephony charges incurred on your Twilio account are your responsibility.

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. Without limiting it, you agree not to use the Service to:

You are solely responsible for the calls your agents place and receive and for compliance with all communications laws that apply to them. In particular, you acknowledge and agree that:

Pinecall provides tooling but does not obtain these consents for you and is not responsible for your agents’ conduct. You will defend, indemnify and hold DeutschePolska harmless from any claim arising out of your use of the Service in violation of these Terms or applicable law, to the maximum extent permitted by law.

6. Fees

Paid plans and usage-based charges are billed as described on our pricing page and processed by our payment provider (Stripe). Telephony and third-party provider costs incurred on your own connected accounts are billed by those providers directly. Except as required by law, fees are non-refundable.

7. Data & privacy

Our handling of personal data is described in our Privacy Policy. As between the parties, you are the controller (or business) of the data your agents process, and Pinecall processes it on your behalf to provide the Service. Where you require a data processing agreement (for example under the GDPR or CCPA), our standard Data Processing Addendum is available on request at info@pinecall.io and, once executed, forms part of these Terms.

8. Intellectual property

The Service, including the software, SDKs and documentation, is owned by DeutschePolska and its licensors. You retain ownership of your content, prompts and data. You grant us the limited rights needed to operate and provide the Service to you.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. Pinecall does not warrant that the Service will be uninterrupted, error-free or that calls will always connect. Outputs generated by AI models may be inaccurate and should not be relied upon as professional advice.

10. Limitation of liability

To the maximum extent permitted by law, Pinecall will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the three months before the event giving rise to the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the platform.

12. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. You and DeutschePolska submit to the exclusive jurisdiction of the state and federal courts located in New Mexico for any dispute arising out of or relating to these Terms or the Service.
